BY-LAWS FOR MATJHABENG LOCAL MUNICIPAL COUNCIL
 

BACKGROUND

Matjhabeng Local Municipal Council is enjoined by the Constitution, the Municipal Structures Act, and the Municipal Systems Act to pass by-laws. The Municipal Council may within the framework provided by Legislation, make a by-law to further regulate its internal procedures of law making.

The constitution in particular sets two basic requirements for municipal law making, namely:

  • a by-law must have the support of the majority of Councillors.

  • the community must have enjoyed the opportunity to have its say with regard to that by-law.

On the 18th August 2006, the proposed draft by-laws were presented to Mayoral Committee for noting whereupon it was resolved that the legal process for developing by-laws be followed.

All the necessary legal processes have been followed and all the by-laws have been subjected to the public participation process and thus incorporate the comments from the public and other relevant stakeholders. These draft by-laws are to be presented to council for debating and passing thereof whereupon the process of promulgation will be embarked upon.
